EurAsEC transitional provisions about “Requirements on mineral fertilizers” (TR EAC 039/2016)
Mineral fertilizers can be still produced and sold even if their compliance assessment documents were made before the technical regulation appeared (TR EAC 039/2016). EurAsEC has decided to ask Republic of Belarus to assist in working out international assessment standards for mineral fertilizers. Minister of the Commission waits for sanitary solutions for fertilizer products not later than 6 months before technical regulations become effective.
Based on the documents of EurAsEC and Customs Union, it was decided:
- Assessment documents about “requirements on mineral fertilizers” in EurAsEC countries, which were approved before technical regulation TR EAC 039/2016 came effective, are valid until its due date or no longer than 18 months after technical regulations come in power. Within 18 months since technical regulation becomes effective it is possible to produce and sell products inside the territory of EurAsEC countries with assessment documents, which were approved before technical regulation came in force. Such products must have a national conformity mark. Within 6 months after technical regulations become effective it is possible to distribute products without assessment documents, which were not required to be assessed previously. No conformity mark is needed in this case. It is important, that products circulation is acceptable only within the due dates of the goods, which are specified according EurAsEC legislation.
- Republic of Belarus is responsible for creating international standards for handling compliance assessment procedures for fertilizer products. This list of standards is supposed to be done in cooperation with member countries and affect only those fertilizers, which conformity assessment documents are required. Member countries and Republic of Belarus are also supposed to work out a list of products, for which it is required to provide compliance assessment documents along with customs declaration.
- Amend decision №299 made by Customs Union of the Commission about unified sanitary epidemiological and hygienic requirements for goods, which are subject to sanitary and epidemiological supervision, must be presented to the minister of EurAsEC Koreshkov V.N. not later than 6 months before technical regulations become effective.
- Present decision comes in force after 30 calendar days since the date of public announcement.
