The entry into force of the technical regulations for alcoholic beverages was postponed again
From January 2, 2022, the decision of the EAEU Council No. 139 with amendments to the EU technical regulations regarding the safety of alcoholic beverages will apply on the territory of the Eurasian Economic Union countries. Pursuant to it, the date of entry into force of the provisions of the document is postponed again.
Details on the regulations for alcoholic beverages
The document was adopted on December 2, 2021 and was published the next day. The approved changes relate to the decision of the Council of the Eurasian Economic Commission No. 98 of December 5, 2018 regarding the technical regulation "On the safety of alcoholic beverages".
The entry date has been postponed once again
The key change introduced under the published decision is the setting of a new date for the entry into force of the so-called alcohol regulations. According to the provisions of the document, it will apply from January 1, 2024.
Attention is drawn to the fact that this is not the first postponement of the effective date of the technical regulation TR 047/2018. It was originally planned to enter into force on January 1, 2021. Then, by the decision of October 30, 2020, this date was postponed to January 1, 2022 due to the need to update some provisions of the regulations after the discussion on the revised draft changes in the spring. It was also necessary to normalize the market in connection with the COVID-19 pandemic.
Details of the mandatory conformity assessment
The current version of the technical regulation TR 047/2018 provides for a mandatory conformity assessment of alcoholic beverages in the form of a declaration of conformity and state registration.
On the other hand, products of the new type are subject to the state registration procedure. It should be carried out in accordance with the provisions of the technical regulation TR CU 021/2011 "On food safety".
In the case of the declaration of conformity, scheme 4d is used for a batch of alcohol, and schemes 3d or 6d for commercially available products. The documents being the basis for accepting the declaration of conformity are:
- information on the registration or registration number of the applicant
- product safety management system certificate (diagram 6d)
- shipping documents
- contract with the manufacturer, etc.
