The changes to the bottled drinking water safety regulations have been approved

On September 16, 2021, the order of the Management Board of the Eurasian Economic Commission No. 135 on the technical regulations of the Union "On the safety of packaged drinking water, including natural mineral water" was officially published and entered into force.

The document was adopted on September 13, 2021. The most important provision concerns the approval of the draft decision of the Council of the Commission "On amending the decision of the Council of the Eurasian Economic Commission of June 23, 2017 No. 45". This decision concerned the approval of the technical regulation TR EAEU 044/2017 on bottled drinking water. Amendments, which will be discussed below, will be sent to the Council of the Committee for consideration. This document will enter into force in 6 months.

2 main changes to the technical regulations

The approved amendments introduce 2 key changes in the technical regulations. It is about:

1) exclusion of sec. 2 of the third paragraph, according to which the technical regulations on bottled drinking water shall enter into force on 1 January 2019, with the exception of item 1 of Annex 1. This entry concerns the value of the mass concentration of the biologically active ingredient "boron (expressed as orthoboric acid)" in the natural mineral water "Bornaia".

2) clarification of the rules regarding the mass concentration value of this component. In the case of healing water, this value should be greater than 100.0 (previously 60.0), and for healing drinking water the value of "≥ 35.0 but ≤ 100.0" instead of the current indicator "≥ 35.0 but ≤ 60 "0".

These values ​​are specified in item 1 of Annex 1 to the regulation "Standards for mass concentrations of biologically active ingredients in natural mineral water to classify it as healing natural mineral water or table healing natural mineral water".

Mandatory conformity assessment

Section 9 of the Technical Regulation TR EAEU 044/2017 establishes a mandatory conformity assessment of bottled drinking water in the following forms:

  • state registration for drinking water intended for the preparation of baby food and natural healing mineral water
  • declaration of conformity for other types of water
