Discussion on the draft changes to the transitional provisions for alcoholic products

On January 20, 2022, a public discussion began on the draft decision of the EAEU Council "On changing the decision of the Board of the Eurasian Economic Commission of April 16, 2019 No. 61". on transitional provisions for alcohol products.

The rules of the transition period

This decision is related to the approval of the transitional provisions of the technical regulation TR EAEU 047/2018 of the Eurasian Economic Union "On the safety of alcoholic products". This document specifies an end date for this period. It was also established that the conformity assessment documents for alcoholic products issued before the date of entry into force of the regulation will be valid until their validity, but no later than January 9, 2024. Until that date, the production and placing on the market of products is possible, provided that they are available with required permits. The transitional period allows for a smooth transition to the new rules on the labeling of alcoholic products, as well as the re-use of packaging with the old label.

The end date of the transition period changed

The new decision of the EAEU Council puts forward a proposal to end the application of the transitional provisions on January 1, 2027. This change results from the postponement of the entry into force of the technical regulations themselves. On December 2, 2021, the Commission Council Decision No. 139 was adopted, according to which the technical regulation TR EAEU 047/2018 will enter into force on January 1, 2024. This is a later date than originally planned.

List of products not subject to the regulations

The technical regulations for alcoholic products were approved on December 5, 2018 by the decision of the Council of the Eurasian Economic Commission No. 98. The list of products containing ethyl alcohol, which is not subject to the regulation, includes:

  • kvass
  • beer and beer drinks with an ethyl alcohol content of not more than 0.5%
  • grape honey and fruit must
  • confectionery flours and sugar products
  • soft drinks, etc.
