The history of the technical regulations. Certification of conformity Russia.
In the preamble to the Russian Law on "Protection of Consumer Rights" (effective from 09.01.1996 No. 2-ФЗ, from 17.12.1999 No. 212-ФЗ)
the following definitions appear for the first time: "Regulation" and "Technical regulation. Thus, "Regulation - is a document that contains the mandatory legal standards and which is approved by the state authorities.
Technical regulation - is a regulation, which establishes the characteristics of products (services) and processes related to the production of goods and the method of their production. Technical regulation may also specify: terminology, symbols, signs, packaging, marking or labeling method, and may be completely devoted exclusively to the issues”. It is known that in Russia just a few years ago GOST standards and norms SanPiN(СанПин, СНиП) were widely used, additional requirements were also defined in the standards of construction. Several years ago it appeared that all the above-mentioned standards and laws were not effective enough to make the process of certification of conformity assessment proceeded efficiently and taking into account all the features of the product. Some of the GOST standards were outdated and did not reflect the reality of the modern system and administration in Russia. Changes were required. GOST standards that have been worked out yet in the Soviet Union, have been replaced by the technical regulations, the use of which is mandatory at the moment. Some of the GOST standards became voluntary, the new technical regulations are now obligatory to use for the quality conformity compliance.
Issuing the GOST R certificate.
As a result of the certification according to GOST standards the certificate of conformity GOST-R is issued. Certificate of conformity GOST-R may take voluntary or mandatory form. Voluntary Certificate of conformity GOST-R is issued on the blue governmental paper. Mandatory certificate of conformity GOST-R is printed on the yellow governmental paper . Not always, however, as a result of the certification the certificate of conformity GOST-R is issued. In some cases, you may the Declaration of conformity GOST-R is a proper document. It is a kind of statement of the manufacturer affirming the product's conformity with GOST standards and approved by an accredited certification body. Both the certificate of conformity GOST-R and the declaration of conformity GOST-R may be issued for 1, 2 or 3 years or for one party of products.
Similarly technical regulations certification is being held. . As a result of the certification of conformity with the technical regulation there may be issued either technical regulations certificate of conformity and the technical regulations declaration of conformity.
Differencies between Technical Regulations certificate and GOST certificate:
First, the technical regulations certificate of conformity unlike the certificate of conformity GOST-R may be issued only in accordance with the mandatory technical regulation. There is no possibility of a voluntary technical regulations certificate of conformity to be issued in Russia and the Customs Union.
Second, the validity of the certificate of conformity with the technical regulation ranges from 1 year to 5 years.
Third, the validity of the technical regulations declaration of conformity , unlike the declaration of conformity GOST-R, is defined in the applicable technical regulation. Which means that the technical regulations declaration of conformity has specifically indicated duration in the applied regulation.
